Terms of Service

1. Who we are

SignificanTRUST is a fraud detection technology company registered in Armenia, with a Delaware C-Corporation registration in progress. We operate the SignificanTRUST Certainty Engine — a real-time fraud detection API. References to "we", "us", or "SignificanTRUST" in these terms refer to this entity.

2. The service

SignificanTRUST provides a real-time fraud detection API (the "Service") that analyses behavioural event sequences and returns a mathematically-derived fraud decision, reasoning trace, and audit trail. The Service is provided via API access and is intended for use by businesses, not individual consumers.

The free trial provides access to 1,000 events using the same production-grade API, proof chain, and audit trail as paid plans. No features are artificially limited during the trial.

3. Your account

To access the Service you must provide a valid work email address, your name, and your company name. You are responsible for keeping your API key secure. Do not share your API key publicly or commit it to source control. If your key is compromised, contact us immediately at support@significantrust.com.

You must provide accurate information when signing up. We reserve the right to suspend accounts where we believe information provided is false or misleading.

4. Free trial terms

The free trial gives you 1,000 API events at no cost. The following conditions apply:

• One free trial per company
• Trial events expire 30 days after your API key is issued if not used
• No credit card is required and no charges are applied automatically at the end of the trial
• You must upgrade to a paid plan to continue using the Service after your trial events are exhausted
• We reserve the right to terminate or modify the free trial offer at any time

5. Acceptable use

You may use the Service only for lawful fraud detection and risk assessment purposes within your own platform. You must not:

• Use the Service to process data you are not authorised to process
• Resell, sublicense, or white-label the Service without a written agreement with us
• Attempt to reverse-engineer, decompile, or extract the underlying model or algorithms
• Use the Service to discriminate against individuals on the basis of protected characteristics
• Send synthetic, fabricated, or deliberately adversarial data to probe or manipulate the model
• Exceed your plan's rate limits or attempt to circumvent them
• Use the Service for any purpose that violates applicable law

6. Your data and our API

When you send transaction events to our API, the following applies:

• You retain full ownership of the data you send to the API
• We process your data solely to return a fraud decision to you
• We do not use your transaction data to train, retrain, or modify the model
• We do not sell or share your transaction data with any third party
• Transaction-level data is not retained beyond the session
• Aggregate performance statistics may be retained to generate your performance audit report

If your use case requires a formal Data Processing Agreement (DPA) — for example, if you operate under GDPR as a data controller — contact us at privacy@significantrust.com before going live.

7. Intellectual property

The SignificanTRUST Certainty Engine, the VLS-Markov behavioral sequence model, all associated software, documentation, and the SignificanTRUST brand are the exclusive intellectual property of SignificanTRUST. The underlying research is published under IEEE peer review at doi.org/10.1109/ACCESS.2020.3039166.

Your use of the Service does not grant you any ownership or licence over our intellectual property beyond what is necessary to use the API as described in our documentation.

8. Service availability

We aim to provide a reliable, high-availability service. However, we do not guarantee uninterrupted access. We may perform maintenance, upgrades, or experience outages. We will communicate planned maintenance in advance where possible. We are not liable for losses arising from service interruption.

9. Fraud decisions and liability

The SignificanTRUST API returns a mathematically-derived fraud decision and reasoning trace. This output is a tool to support your fraud prevention process — it is not a substitute for your own compliance, legal, or risk management judgement.

You remain solely responsible for the decisions you make based on API output, including decisions to block, approve, or flag transactions. SignificanTRUST is not liable for any loss, regulatory penalty, or legal claim arising from your use of, or reliance on, API decisions.

10. Limitation of liability

To the maximum extent permitted by law, SignificanTRUST's total liability to you for any claim arising from these terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these terms, if your account is inactive for more than 12 months, or if we discontinue the Service. On termination, your API key will be revoked and any remaining trial events will be forfeited.

12. Changes to these terms

We may update these terms from time to time. We will notify active users of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised terms.

13. Governing law

These terms are governed by the laws of the Republic of Armenia. Once our Delaware C-Corporation registration is complete, we will update the governing law clause to reflect our US entity. We will notify users of this change.

Any disputes arising from these terms will be resolved first through good-faith negotiation. If resolution cannot be reached, disputes will be referred to the competent courts of the Republic of Armenia.
